ABOUT THE SERVICE

The City Legal Officer renders assistance to the constituents by rendering free legal counseling. The office hopes to provide   clients immediate relief on their legal problem, and guide them forwards the proper direction in attaining such relief.

  • Referral when necessary

II. REQUEST FOR A WRITTEN LEGAL OPINION
ABOUT THE SERVICE

As the City’s Legal Counsel, the City Legal Officer is depended upon by various departments and Barangays  on issues involving interpretation or applicability of the law. The office renders Legal opinion on the basis of a written query and given a particular set of facts. A constituent may seek legal; opinion regarding the applicability of the law on the actions taken by a city office or department in rendering a particular service, or its denial of a request for service. The legal department may resolve the issue with a sound opinion based on law, fact & jurisprudence.

This service is particularly available to all the city constituents in connection with various transactions requiring authentications or certified true copy entered into for clean and/or good record with the government.

IV. OBTAINING AND NOTARIZING AFFIDAVITS AND OTHER LEGAL DOCUMENTS
ABOUT THE SERVICE

The legal department prepares and notarizes affidavits and other legal documents from the requesting constituents. Persons requesting for subscription under oath must be present in front of the administering counsel.

V. FILING ADMINISTRATIVE CASE
ABOUT THE SERVICE

Cases against city employees and officers are filed before the Legal Department. The procedure for administrative cases is pursuant to the civil service rules and regulations appurtenant thereto.

REQUIREMENTS

Constituents may file a complaint with the legal department containing the following information

  1. Full name and  address of the complainant;
  2. Full name and  address of the person complained of as well as his position and office of employment;
  3. A narration of the relevant and materials f acts which shows the acts or emissions as allegedly committed by the civil servant;
  4. Certified true copies of documentary evidence and affidavits of witnesses, if any; and
  5. Certification or statement of non-forum shopping.
PROCEDURE
  1. Complaint is filed with the Human Resource Development Office at the 2nd Floor, which will forward the same to the Legal Department.
  2.  Preliminary investigation will be conducted wherein dismissal of the complaint or issuance of a formal charge will be determined.
  3. Upon issuance of a formal charge, a formal investigation will be held where parties concerned will attend hearings.
  4. Upon the end of the investigation, dismissal of the complaint or imposition of penalties will be recommended by the Legal Department.
